Is Speed Unfair? The Fairness Debate

Being faster than other traders isn't new — but modern markets let a speed edge be measured in microseconds and monetized systematically, which raises a genuinely different fairness question than 'the early bird gets the worm.'

Traders have always paid for an information or speed edge — a phone line instead of a telegram, a floor position closer to the specialist's post. What's different about modern high-frequency trading is scale and systematicity: firms spend hundreds of millions of dollars on microwave towers and co-located servers to shave single-digit microseconds off a round trip, and that edge translates into a repeatable, near-guaranteed profit against slower participants on specific trade types. The fairness debate is really about whether that kind of edge is a legitimate reward for infrastructure investment or a structural tax on everyone else.

The case that it's fine

One view holds that speed is just another dimension of competition, no different in kind from analysts working harder to find an edge in fundamentals. If speed genuinely improves market quality — tighter spreads, faster incorporation of news into prices — then paying for it is paying for a public good, and firms that don't want to compete on speed can still compete on other dimensions, like patience or size. Regulators have generally allowed the arms race to continue on this reasoning, intervening only around specific abuses like quote stuffing rather than banning speed advantages outright.

The case that it's a problem

The counter-argument focuses on latency arbitrage specifically: a strategy that detects a price move on one venue and races to pick off stale quotes on another venue before slower market makers can update, capturing a close-to-riskless profit that comes directly out of those market makers' pockets, who then have to widen spreads to compensate. Critics argue this isn't price discovery or a service to end investors — it's a toll extracted purely from being fast, and every investor pays for it indirectly through wider spreads set by market makers protecting themselves against exactly this risk. Proposed fixes like frequent batch auctions and speed bumps exist specifically to neutralize the value of a pure speed edge without banning speed-based strategies outright.

What this means in practice

Most concrete regulatory responses — randomized speed bumps at some exchanges, the IEX "magic shoebox" delay, and debates over co-location fee structures — aim not at banning speed but at narrowing the specific type of edge that comes purely from beating other liquidity providers to a stale quote, while preserving the competitive benefits of faster, cheaper price discovery generally.

The fairness debate isn't "is speed allowed" — it's about distinguishing speed that improves prices for everyone from speed that only exists to extract value from slower liquidity providers, and market design increasingly tries to blunt the second without banning the first.
